Terms & Conditions

These Terms explain the conditions that apply when you use the Living Eternity website, purchase directly from Living Eternity, book a conversation with Michael, or use Pay It Forward.

1. About these Terms

These Terms & Conditions apply to the Living Eternity website and to products and services supplied directly by Living Eternity, an Australian sole-trader business operated by Michael J. Simmons, ABN 94 942 331 265, based on the Gold Coast, Queensland, Australia.

By using this website or placing an order, booking or recurring support arrangement directly with Living Eternity, you agree to the Terms that apply at that time. If a separate checkout, booking platform or third-party retailer displays additional terms, those terms may also apply to that transaction.

Our Privacy Policy explains how personal information is handled.

2. Website use

You may use this website for lawful personal and informational purposes. You must not knowingly interfere with the website, attempt unauthorised access, introduce malicious code, misuse forms or services, or use the site in a way that infringes another person's rights.

We may maintain, update or temporarily suspend parts of the website where reasonably necessary for security, maintenance, technical or business reasons.

3. Orders, prices and payments

Prices are shown in Australian dollars (AUD) unless stated otherwise. Delivery charges and any other applicable charges will be shown before payment where relevant.

Direct Living Eternity transactions may be processed through PayPal and our e-commerce platform. Payment details handled directly by a payment provider are also subject to that provider's terms and privacy practices.

An order is subject to availability and successful payment. If we cannot supply a directly purchased item within a reasonable time, we will contact you and provide an appropriate solution, which may include a replacement, alternative or refund.

4. Shipping and delivery

Shipping charges and available delivery options for products supplied directly by Living Eternity are displayed through the relevant checkout where available.

Delivery timeframes are estimates unless expressly stated otherwise. Delays can occur because of postal, courier, customs, weather or other circumstances outside our direct control. If a parcel is significantly delayed, lost or arrives damaged, please contact us so we can investigate and provide the remedy required by applicable law.

5. Returns, refunds and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.

If a product is faulty, damaged, unsafe, materially different from its description, or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

Australian Consumer Law does not generally require a business to provide a refund solely because a customer changes their mind. We may consider a change-of-mind request case by case without limiting any rights you otherwise have by law.

6. A Conversation with Michael — bookings

The duration, price, available times and payment requirements for a private conversation are shown on the booking page before you confirm the booking.

If you need to cancel or reschedule, please use the booking tools provided or contact Living Eternity as soon as reasonably possible. Any specific cancellation or rescheduling terms clearly displayed before booking also form part of the booking agreement, subject to applicable law.

A Conversation with Michael is a reflective personal conversation. It is not a substitute for medical, psychological, legal, financial or other regulated professional advice or treatment.

A session will not be recorded by Living Eternity unless recording has been disclosed and agreed beforehand.

7. Pay It Forward

Pay It Forward is a voluntary way to support the Living Eternity project and its writing, publishing, music, film and conversations. It is not represented as a charitable donation or tax-deductible gift, and Living Eternity does not represent itself as a deductible gift recipient (DGR).

One-off and recurring Pay It Forward amounts are shown before payment. Where you choose monthly support, you authorise the recurring amount and billing frequency displayed by the payment provider until the arrangement is cancelled.

You may cancel future recurring Pay It Forward payments through the payment provider's available account or subscription controls, or contact Living Eternity for assistance.

Pay It Forward does not purchase ownership, investment rights, creative control or a guaranteed financial or material return unless a separate written agreement expressly states otherwise.

8. Third-party platforms and external purchases

Living Eternity uses or links to third-party services such as PayPal, TidyCal, Google services, Amazon, DashNex / MyEcomShop and Cloudinary. Those services are operated independently and may have their own terms, fees, privacy practices and availability.

If you purchase through an external retailer, that retailer's checkout, delivery, return and refund terms apply in addition to any rights you have under applicable law.

9. Intellectual property

Unless otherwise stated, the original writing, acrostics, text, branding, artwork, audio, creative concepts and other original material presented through Living Eternity are owned by or licensed to Michael J. Simmons / Living Eternity and are protected by applicable intellectual property law.

You may view the website for personal use and share links to Living Eternity. You must not reproduce, republish, sell, adapt, distribute or commercially exploit a substantial part of Living Eternity's original material without permission, except where permitted by law.

10. Spiritual, reflective and creative content

Living Eternity presents spiritual perspectives, mythology, creative writing, personal experiences, interpretation, acrostic rhyme, music and narrative material for reflection, discussion and creative expression.

Statements about spirituality, consciousness, purpose, eternity or related themes are not presented as medical, psychological, legal, financial or other regulated professional advice.

11. Liability and rights that cannot be excluded

Nothing in these Terms is intended to exclude or limit a right, guarantee, remedy or liability where doing so would be unlawful, including rights under the Australian Consumer Law.

To the extent permitted by law, Living Eternity is not responsible for loss caused solely by circumstances outside its reasonable control, by your misuse of the website or services, or by an independent third-party platform where Living Eternity did not cause or contribute to the loss.

12. Changes to these Terms

We may update these Terms for future use of the website and future transactions when our services, providers or legal obligations change. The current version will be published on this page with its effective or last-updated date.

13. Governing law and resolving concerns

These Terms are governed by the laws of Queensland, Australia and applicable Commonwealth laws. Nothing in this clause prevents a person from relying on a mandatory right or jurisdiction available to them under applicable law.

If a concern arises, please contact Living Eternity first so we have a reasonable opportunity to understand and resolve it.
